By accessing or using any service, website, platform, or product provided by MALA Group Inc. ("Company," "we," "our," "us"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use our services.
1. Definitions
"Services" means all products, platforms, websites, data feeds, software, APIs, and related services provided by MALA Group Inc. "Client" means any individual or entity that registers for, accesses, or uses our Services. "Data" means any consumer records, property records, vehicle records, or other data products provided through our Services. "Portal" means the client-facing web application for accessing and managing Services.
2. Account Registration
To access certain Services, you must create an account. You agree to: provide accurate, current, and complete information, maintain and promptly update your account information, maintain the security and confidentiality of your login credentials, accept responsibility for all activities under your account, and notify us immediately of any unauthorized use. We reserve the right to suspend or terminate accounts at our sole discretion, including for violations of these Terms.
3. Service Use and Restrictions
Subject to these Terms and any applicable Data License Agreement, you are granted a limited, non-exclusive, non-transferable right to access and use the Services for your internal business purposes. You agree not to: sublicense, resell, redistribute, or share Data with any third party without express written authorization, use the Services for any unlawful purpose or in violation of any applicable law or regulation, attempt to gain unauthorized access to any portion of the Services, reverse engineer, decompile, or disassemble any aspect of the Services, or use automated systems (bots, scrapers, crawlers) to access the Services without authorization.
4. Data Licensing
All Data provided through our Services is licensed, not sold. Data is provided for single-use direct marketing purposes unless otherwise specified in a written Data License Agreement. All data deliveries may contain seed and monitoring records. Unauthorized redistribution or misuse of Data constitutes a material breach of these Terms and may result in immediate termination and legal action. See our Data Usage Policy and Acceptable Use Policy for detailed terms.
5. Payment Terms
Payment for Services is due in advance of data delivery unless otherwise specified in a written agreement. All fees are non-refundable unless expressly stated otherwise. We reserve the right to modify pricing with thirty (30) days written notice. Late payments may incur interest at the rate of 1.5% per month or the maximum rate permitted by law, whichever is less.
6. Intellectual Property
All content, software, code, algorithms, scoring models, database structures, trademarks, logos, and intellectual property associated with the Services are and remain the exclusive property of MALA Group Inc. Nothing in these Terms grants you any ownership rights in our intellectual property. You may not use our name, logo, or trademarks without prior written consent.
7. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, MALA GROUP INC. SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, REVENUE, BUSINESS OPPORTUNITIES, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICES, REGARDLESS OF THE THEORY OF LIABILITY. OUR TOTAL AGGREGATE LIABILITY SHALL NOT EXCEED THE AMOUNT PAID BY YOU FOR THE SPECIFIC SERVICE GIVING RISE TO THE CLAIM DURING THE TWELVE (12) MONTHS PRECEDING THE EVENT.
8. Indemnification
You agree to indemnify, defend, and hold harmless MALA Group Inc., its officers, directors, employees, agents, and affiliates from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: your use of the Services, your violation of these Terms, your violation of any applicable law or regulation, any misuse of Data obtained through our Services, or any claim by a third party arising from your use of our Data or Services.
9. Disclaimer of Warranties
THE SERVICES AND ALL DATA ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, COMPLETENESS, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.
10. Termination
Either party may terminate these Terms at any time with written notice. We may immediately suspend or terminate your access if you breach any provision of these Terms. Upon termination: all licenses and rights granted to you will immediately cease, you must immediately stop using any Data obtained through the Services, you must destroy all copies of Data in your possession within ninety (90) days, and all outstanding payment obligations become immediately due and payable.
11. Governing Law and Dispute Resolution
These Terms are governed by and construed in accordance with the laws of the State of Florida, without regard to conflict of law principles. Any dispute arising under these Terms shall be resolved exclusively in the state or federal courts located in Palm Beach County, Florida. Both parties consent to the personal jurisdiction of such courts.
12. Modifications
We reserve the right to modify these Terms at any time. Material changes will be communicated via email or prominent notice on our website. Continued use of the Services after changes constitutes acceptance of the modified Terms.
13. Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.
14. Entire Agreement
These Terms, together with any applicable Data License Agreement, Service Order, and policies incorporated by reference, constitute the entire agreement between you and MALA Group Inc. regarding the Services.

MALA Group Inc. aggregates data from multiple third-party sources including but not limited to state motor vehicle registrars, county recorder offices, national property databases, and public records. While we employ rigorous validation, scoring, and deduplication processes, we do not guarantee the accuracy, completeness, timeliness, or reliability of any data provided through our services.
Data records may contain errors originating from source providers, transcription processes, or timing of public record updates. Consumers may have changed addresses, sold vehicles, refinanced properties, or otherwise altered their circumstances since the data was last updated. MALA Group Inc. shall not be held liable for any decisions made or actions taken based on data that is inaccurate, incomplete, or outdated.
2. Equity and Property Estimation Disclaimer
Any property equity estimates, home valuations, mortgage balance projections, or refinance scoring provided through our services are estimates only and should not be construed as appraisals, Automated Valuation Models (AVMs), or professional property assessments. These estimates are calculated using publicly available data and statistical models and may differ significantly from actual values. They are provided for marketing targeting purposes only and are not suitable for lending, underwriting, insurance, or investment decisions.

MALA Group Inc. does not provide data covered under the FCRA and our data products are not intended for use in credit, insurance, employment, or tenant screening decisions.
7. Third-Party Content
Our services may reference or link to third-party services, websites, or content. We do not endorse, control, or assume responsibility for any third-party content, products, or services.
8. Force Majeure
MALA Group Inc. shall not be liable for any failure or delay in performance resulting from causes beyond our reasonable control, including but not limited to acts of God, natural disasters, pandemics, war, terrorism, government actions, power failures, internet disruptions, or data source outages.
Data Usage Policy

This policy governs how data obtained through MALA Group Inc. services may and may not be used. All clients and data recipients are bound by this policy. Violations may result in immediate termination, financial penalties, and legal action.
1. Permitted Uses
Data provided by MALA Group Inc. is licensed exclusively for the following purposes: single-use direct mail marketing campaigns, telephone marketing (in compliance with TCPA and applicable Do Not Call laws), email marketing (in compliance with CAN-SPAM Act), internal analytics and market research, customer matching and deduplication against your existing records, and any other use expressly authorized in a written Data License Agreement.
2. Prohibited Uses
The following uses of our data are strictly prohibited: redistribution, resale, sublicensing, or sharing of data with any third party without express written consent, use for any purpose regulated under the Fair Credit Reporting Act (FCRA) including credit decisions, insurance underwriting, employment screening, or tenant screening, use for stalking, harassment, intimidation, or any unlawful purpose, creating derivative databases or data products for commercial resale, scraping, harvesting, or automated extraction from our platforms beyond authorized methods, using data to discriminate against individuals on the basis of race, color, national origin, religion, sex, familial status, disability, or any other protected class.
3. Single-Use Licensing
Unless otherwise specified in a written agreement, all data is licensed for single-use. This means data may be used for one (1) campaign or mailing. Reuse of the same data for subsequent campaigns requires a new data pull and payment. Records that respond to your campaign (i.e., inbound callers, purchasers) become your customer records and are excluded from single-use restrictions.
4. Data Destruction Requirements
All data that is not converted to a customer relationship must be destroyed within ninety (90) days of delivery. "Destroyed" means permanently deleted from all electronic systems, databases, backup media, and physical copies. Upon request, you must provide written certification of data destruction.
5. Seed and Monitoring Records
Every data delivery contains embedded seed and monitoring records. These records are proprietary and are used to detect unauthorized redistribution or misuse. Seed records are indistinguishable from actual consumer records. Detection of seed records in unauthorized channels constitutes conclusive evidence of a breach. Liquidated damages of five dollars ($5.00) per record may apply for unauthorized use of data, in addition to any other remedies available at law or in equity.
6. Suppression and Do Not Contact
Clients are responsible for suppressing records against applicable Do Not Call (DNC) lists, Do Not Mail lists, and their own internal suppression files before initiating any campaign. MALA Group Inc. performs data-level suppression during processing but does not warrant complete DNC compliance. Final DNC scrubbing is the Client's responsibility.
7. Data Security Requirements
Clients must implement reasonable administrative, technical, and physical safeguards to protect data from unauthorized access, use, or disclosure. At a minimum, clients must: store data in encrypted or access-controlled systems, limit access to authorized personnel, use secure transmission methods (encrypted email, SFTP, etc.) when transferring data, and promptly report any data breach to MALA Group Inc.
8. Audit Rights
MALA Group Inc. reserves the right to audit client data usage practices to ensure compliance with this policy. Audits may be conducted with reasonable notice and during normal business hours. Failure to cooperate with an audit constitutes a material breach of these terms.
California Consumer Privacy Act (CCPA/CPRA) Notice

This notice supplements our Privacy Policy and applies solely to residents of California, as required under the California Consumer Privacy Act of 2018 (CCPA) as amended by the California Privacy Rights Act of 2020 (CPRA).

You may not use our platforms to: attempt to gain unauthorized access to any systems, accounts, or data, upload or transmit viruses, malware, or other harmful code, engage in any activity that disrupts or interferes with the Services, use automated tools (bots, scrapers, crawlers) without authorization, impersonate any person or entity, violate the intellectual property rights of MALA Group Inc. or any third party, harass, abuse, or harm any individual using data obtained through our Services, engage in any deceptive, fraudulent, or illegal activity, circumvent or attempt to circumvent any security measures, access or use data for any purpose not authorized under your agreement.
3. Artwork and Content Upload
When uploading artwork, creative assets, or content to our platform, you represent and warrant that: you own or have obtained all necessary rights, licenses, and permissions for the content, the content does not infringe upon any third-party intellectual property rights, the content does not violate any applicable laws including advertising standards and truth-in-advertising requirements, the content is not obscene, defamatory, or otherwise objectionable, and you assume full responsibility for any claims arising from the content.
4. Communication Standards
All marketing communications sent using data or services from MALA Group Inc. must: comply with the CAN-SPAM Act for email communications, comply with the Telephone Consumer Protection Act (TCPA) for phone communications, comply with U.S. Postal Service regulations for direct mail, include accurate sender identification and valid physical mailing address, honor opt-out and unsubscribe requests within the legally required timeframe, and not contain misleading, deceptive, or false claims.
5. Reporting Violations
If you become aware of any violation of this Acceptable Use Policy, please report it immediately to info@malagroup.com.
6. Enforcement
We reserve the right to investigate suspected violations and take any action we deem appropriate, including: issuing warnings, suspending or terminating accounts, removing content, reporting illegal activity to law enforcement, and pursuing legal remedies. We may take enforcement action at our sole discretion and without prior notice when we believe the integrity of our platform or the safety of individuals is at risk.
7. Cooperation with Law Enforcement
We will cooperate with law enforcement agencies in connection with any investigation of illegal activity conducted through or involving our Services. We may disclose account information and usage data when required by law or when we believe in good faith that disclosure is necessary to protect our rights, protect your safety or the safety of others, or investigate fraud.
